The
Decree of Presidium
of Supreme Council of USSR
About
the declaration of State of Emergency in NKAO and other districts
The
Presidium of Supreme Council of USSR noted, that despite of the measures
have been taken, the situation in NKAO of Azerbaijan SSR and around it
not only became normal but continues worse. The actions of numerous of
nationalist and separative unions carrying out the instigating work livened
up and involve into the struggle more and more people. The extremist groups
organize mass disorders, provoke the strikes, sow discord between nations.
They organize the crime actions, mine the roads and bridges, shell the
localities, take the hostage. The number of refugees, which are don’t
have the normal life and work conditions, increases, there are many victims,
and all this takes place in the peace time. All this worries and angers
the soviet people and all our nation.
In
such a complicate situation the republican bodies of Azerbaijan SSR and
Armenian SSR, the leadership of republics acted not enough strong and
sequentially, didn’t use full potential for changing current situation,
and sometimes came under influence of extremist and nationalist groups.
In connection with this the implementation of decisions of Supreme Council
of USSR are stopped, the escalation of tension because of the relations
between nations. The acts, which didn’t met the requirements of Constitution
of USSR on NKAO issue adopted by Supreme Council of Armenian SSR became
the cause of this.
The
situation in Baku, Ganja and other localities of Azerbaijan currently
is worsened more than usual. There are take place the robbery, killings,
the attempts of armed overthrow of Soviet regime and change-over of established
by Constitution of USSR state and public structure.
In
connection with this and taking into account the appeal of Presidium of
Supreme Council of Azerbaijan SSR, according to the clause 14 of article
119 of Constitution USSR the Presidium of Supreme Council of USSR decrees:
-
To declare
the State of Emergency on the territory of NKAO and the districts
of Azerbaijan SSR around it, Goriys district of Armenia SSR and along
the USSR state border on the territory of Azerbaijan SSR.
-
To give
the authorities, state administration and other state bodies and officials,
named in item 1 of this Decree the rights to take following measures:
- to forbid
the carrying out of meetings, street rallies, demonstrations, and
the performances, sporting and other mass measures, to control the
media;
- to stop
the activity of organizations, which don’t meet the requirements of
law, and activity of the gainful units of citizen or disband they
- to recruit
the citizens for the work at the enterprises, offices and organizations,
as for the liquidation of emergency consequences;
- to forbid
the strikes;
- to impose
a curfew;
- to limit
the entrance and departure of citizens, to move the citizens from
districts, which are dangerous, and if it is necessary to oblige the
citizen, which are not the residents of this place, to leave it;
- to limit
the traffic and implement their control;
- to control
the documents, and if it is necessary in cases, when the person had
weapons and rejected to show it, to implement the individual check
up of citizens and inspection of their things;
- to withdraw
from citizens and if it is necessary from the offices, enterprises
and organizations the guns and cold steel, ammunition, explosives,
chemical and poisonous substances;
- to limit
or forbid using of duplicating machines, transmitting equipment and
to enter the special rules on using of communication;
- The
citizens can not be on the streets or other public places during the
curfew without special passes and identify cards, or be outside without
documents and identify cards.
- The
troops of the interior ministry implement the liquidation of consequences
of emergency situations, protection of the citizens rights, providing
the defense of public order and security and the objects of vital
activity of citizens, as the military unit of Soviet Army, Navy and
Committee of State Security of USSR. The troops of the Interior Ministry
of USSR and drawn military units of Soviet Army, Navy and Committee
of State Security of USSR implement their activity according to the
Constitution of USSR and laws, regulations and this Decree.
- The
persons, who provokes the violation of public order, disseminates
the provocative information or prevents to implement by citizens and
officials their legal rights and obligations, violates the order of
state of emergency and curfew are to detain by administrative order
for 30 days and the persons, who commits a crime, are be called to
account.
- To implement
the security of rail ways and other communications to be drawn the
troops of Interior Ministry of USSR, Soviet Army and Committee of
State Security of USSR.
- To suggest
the Presidium of Supreme Council of Azerbaijan SSR to take all necessary
measures, including the impose of curfew in Baku, Ganja and other
localities with the aim to provide of security of population, enterprises,
offices and organizations, to call to account the persons violating
the requirements of current legislature, including the Decree of Presidium
of Supreme Council of USSR of November 23, 1988 “About the urgent
measures on establishment of order in Azerbaijan SSR and Armenian
SSR” (Bulletin of Supreme Council of USSR, 1988, art. 47, p. 712).
To demand from the Presidium of Supreme Council of Armenian SSR to
take measures for stop the instigating actions on the territory of
this republic, which sow the discord between nations.
To consider as necessary the consideration of practical measures on
implementation of this Decree and overcoming of current situation
by the Presidiums of Supreme Councils of Azerbaijan and Armenian SSR.
The law-enforcement and other state bodies of USSR are to render necessary
assistance to the republic bodies in implementation of this measures.
- The
items 1-7 of this Decree come into force from 23 hours local time,
January 15, 1990 and effect till cancellation of State of Emergency.
- The
Ministry of Foreign Affairs is to continue and complete the talks
on state border regime and connecting with this issues on relation
between USSR and Iran, and is to inform the corresponding states and
international organizations about this Decree.
- To consider
as necessary the imminent consideration in Supreme Council of legal
regime of State of Emergency, which were worked out by Council of
Ministers of USSR by order of Supreme Council of USSR.
- To submit
to the Committee of Supreme Council of USSR on the issues of legislation,
legitimacy and law and order, the Law draft about the increase of
responsibility for the encroachment on the national rights of citizens
and forcible violation of territorial integrity of USSR worked out
by the group of scientist and specialist.
